The Constitutional Court has rejected several paragraphs of seven articles of the Sardinian regional law that implemented the National Home Savings Act in June 2025.

The same Constitutional Court then rejected, declaring the appeals inadmissible , the objections raised by the Council of Ministers on five other parts of the same provision, and declared the objections on two other paragraphs of Article 2 which defines building interventions to be unfounded.

In particular, the section stating that "the construction of a new volume in an existing building is considered renovation if it occurs within the existing footprint and new construction otherwise" was removed .

Some of the regulations governing interventions that are totally or partially inconsistent with the permit, as well as the parking regulations regarding changes to the intended use that are not relevant from an urban planning perspective, have also been rejected.

Among the provisions that remain in effect is the one regarding interventions that involve the complete demolition of pre-existing buildings and their reconstruction.
