The Region has 60 days to adopt the final provision for the Environmental Impact Assessment (EIA) procedure for the expansion of RWM Italia in Domusnovas . Otherwise, a commissioner will be appointed. This is the provision of a ruling by the Sardinia Regional Administrative Court (Regional Administrative Court, TAR , No. 910 of October 17, 2025) regarding the project for the "New R140 Test Field and the new R200 and R210 Departments," built in San Marco, within the municipality of Iglesias.

The company had asked the Region to rule on the environmental compatibility of the works already constructed between 2019 and 2021 , after the Council of State, in a 2021 ruling, overturned a previous decision by the Sardinia Regional Council that had excluded the project from the EIA. RWM Italia SpA subsequently submitted a new request in 2022 and submitted further supplementary documents in 2025.

Although the investigation had been completed and the proposed resolution was ready for approval by the Regional Council, as communicated to the company by the regional offices themselves, the Region has not adopted any measures, not even after a formal formal warning presented by the company in June 2025.

The Regional Administrative Court (TAR) found that the Region had exceeded the deadlines established by its own directives for completing the proceedings and declared the administration's silence unlawful . The Court therefore ordered the Sardinia Region to adopt a final decision on the EIA within sixty days of notification of the ruling.

Should the Region fail to do so, the judge has provided for the appointment of a Commissioner ad acta, identified as the Director General of the Directorate for Environmental Assessments of the Ministry of the Environment and Energy Security or his delegate, charged with completing the procedure within a further sixty days.

The ruling also orders the Sardinia Region to pay 2,000 euros in legal costs to the appellant company RWM Italia SpA.
