The appeal by environmental and peace associations against the RWM expansion is legitimate and will be heard in January 2027, but there is no reason to suspend at this time the decree with which the Government Commissioner gave the green light to the doubling of the bomb-making facilities at Domusnovas.
The Regional Administrative Court of Sardinia (TAR) ruled today. On the one hand, the lawyers representing RWM and the Region requested that the appeal be inadmissible due to "lateness," meaning that it was filed after the deadline . On the other, six environmental and peace associations (Italia Nostra, A Foras, USB Sardegna, Comitato Riconversione RWM, Assotziu Consumadoris Sardigna, Movimento Nonviolento Sardegna) argued for its admissibility.
The Regional Administrative Court of Sardinia rejected the opposing party's objection and confirmed the full validity of the appeal , which therefore continues its proceedings. However, it also rejected the request to suspend the Commissioner's Decree. This is because "at present, the measure would not cause immediate environmental damage, since the plant cannot yet begin production without further authorizations, including those from the Fire Department, the Superintendency, and the necessary building and urban planning documents."
The public hearing to discuss the merits of the appeal has been set for January 14th, and until then the situation will remain frozen and uncertain, at least from a legal standpoint.
