In the Court of Oristano, the offended party Marco Mura, a 34-year-old from Nuoro, assisted by the lawyers Andrea Cocco and Federico Cherchi, appeared as a civil party before the prosecutor Daniela Muntoni and the judge Paola Bussu who then postponed the trial to 17 July.

The story was born in February 2021 when Marco Mura, author of texts trained at the European Center of Toscolano di Mogol, had sued Marco Palumbo for plagiarism and violation of copyright for the song "That night will not fall" .

According to the young man from Nuoro, that passage is a plagiarism of one of his literary works: some parts had been reported identical in the text of the song performed and signed by Paolo Palumbo in the duet with Achille Lauro .

There had been a first formal warning in 2020 (addressed to Marco and Paolo Palumbo and Achille Lauro) but the song had still remained on digital platforms and according to Mura other contents would also have been released without his consent . Hence the complaint, which continued until the trial of Marco Palumbo, 49 years old.
