Carles Puigdemont, the former president of Catalonia in exile after the independence referendum of October 2017, in view of the hearing before the Court of Appeal of Sassari to examine the request for extradition by Spain , has filed an appeal with procedure of urgency to regain his immunity, currently suspended, as MEP. His legal team informs the AFP.

The request was filed with the EU Court. If upheld, a July decision by the EU court that provisionally waived Puigdemont's immunity would be suspended immediately, pending a subsequent ruling on the central issues of the matter. Otherwise, Puigdemont's legal team has made it known that it will ask the EU court to deal with the fullest case on the possible waiver of his immunity.

The EU court's provisional July ruling, while suspending Puigdemont's immunity, also found that Spain's arrest and extradition order (signed in October 2019) across the EU was not in force pending of the most comprehensive EU judicial case.

Last Thursday, the main Spanish judge in an attempt to obtain extradition gave the Italian authorities a document in which he insisted on the validity of the order. The request for an order, the legal source said, "does not affect the hearing on Monday" in Italy, and confirmed that Puigdemont will participate voluntarily in person.

Currently the former number one of the Generalitat is wanted in Spain for sedition and embezzlement of public funds. A week ago he was arrested in Alghero, only to be released immediately.
