Nonetheless, the Milan surveillance court , thanks also to the reports on his "persistent current dangerousness" by the Cagliari general prosecutor, continues to reject the various requests presented by the defense for suspension of sentence for serious health reasons, the last one less than a month ago, despite all the recent medical records attesting to the imminent danger of death having been attached".

The two lawyers recall that even the requests for transfer to a prison in Sardinia, "where proximity to his family could have at least facilitated treatment and alleviated his suffering", have been systematically rejected. "In the penitentiary ward in the San Paolo hospital they have decided that he is no longer curable, but he is denied the possibility of having another medical opinion in an oncology ward of another hospital - Goddi and Vernier argue - after the visit to the prison this morning, having ascertained his almost desperate conditions, we will immediately present yet another request to the surveillance court in Milan with the hope of being able to obtain a positive response.
