Reduced concession fees for the Ferris wheel in Olbia: Kevin Lupetti's company, owner of the plant, wins the legal battle that began in 2022 and reached the Council of State.
The entrepreneur, represented by the lawyers Antonello Desini, Nicoletta Mani and Gianfranco Filigheddu, received the cancellation of the payment order (from the Sardinia Port Authority) of the entire fee for the year 2020, approximately 100 thousand euros. Lupetti's company had asked the Regional Port Authority for a reduction and exemption from the payment, due to the drastic reduction in activity in 2020, caused by the Covid pandemic emergency. The plant is installed on a state-owned area. For the wheel, the application of national rules that lighten the tax burden and fees on public land was requested, to the benefit of companies affected by the pandemic emergency. The Port Authority had said no, arguing that the relief only applies to certain types of concession. The Council of State, however, confirmed that «there is no reason that prevents the application of the exemption, provided for in favor of concessionaires of "public land" (also) to concessionaires of parts of municipal state property, as there are no substantial differences - as to the known needs to relaunch activities in the period of crisis - between activities carried out on municipal land and activities carried out on state property".
Lupetti claims to have suffered serious consequences due to the forced stop of his business during the pandemic emergency.
