The one-year prison sentence was requested by the prosecutor of the Nuoro court, Riccardo Belfiori, against the owner and administrator of the "Gli Ulivi" hotel in Orosei, on trial for the death on 2 September 2018, of Richard Mulas, the 7-year-old boy who was trapped in the pool drain. Both defendants are charged with manslaughter.

In requesting the conviction, the magistrate attributes to the two "responsibility for the maintenance of the pool" having "the legal obligation to avoid, by placing the grate in the drainage outlet which was missing that day, that the pool could be a source of risk for people ".

The civil lawyers, representing little Richard's parents, Francesco Lai and Piera Pittalis, supported the prosecutor's requests, but also requested an immediately enforceable provisional amount of 100 thousand euros for each parent and the rest to be quantified in civil proceedings . Instead, the defendants' defenders, Basilio Brodu and Adriana Brundu, fought, asking for acquittal.

"The responsibility for placing the grate - highlighted the two lawyers - did not lie with Appeddu nor with Gusai, but with Mathias Wincler, director of the company that co-owns the residence".
