The Region had opposed, but the Ministry of the Environment and Energy Security had given the green light anyway. It is the project for an agrivoltaic field in Siamaggiore , on an (unsuitable) area of 64 hectares, for which the green light was given. «The favorable opinion expressed by the PNRR-PNIEC Commission, relating to the elevated agrivoltaic project "Fattoria Solare Siamaggiore 1", is not binding and cannot replace regional legislation», reiterates the regional councilor for Environmental Protection, Rosanna Laconi. «The Sardinia Region will not grant authorizations for plants that do not fall within the suitable areas defined by Regional Law 20/2024».
The Region maintains that the opinion of the commission has no authorizing value. Councilor Laconi specifies: « The final authorization is the exclusive responsibility of the Sardinia Region , which applies its own sector regulations, including Regional Law 20/2024, in accordance with the national regulatory framework and, in particular, the provisions of Article 12, paragraph 3 of Legislative Decree 387/2003. Our decisions respect the will of the Regional Council and the Sardinian population: we will guarantee sustainable development without derogating from the rules for the protection of the landscape and biodiversity».
The Region also announced that it intends to formally challenge the opinion of the PNRR-PNIEC Commission and the ministerial decree , as it believes that they do not take into account the necessary conditions of suitability. "We will firmly defend the correct application of regional and national regulations in the appropriate venues, so that Sardinia's energy planning respects the established rules and does not lend itself to partial or arbitrary interpretations", concludes Laconi.
