Agostina Barbieri, 63, who ended up on trial for the murder, on 11 July 2021 in Borghetto Borbera (Alessandria), of her husband Luciano Giacobone, 64, obtained a partial pardon from the President of the Republic Sergio Mattarella.

In the Assize Court she was sentenced to 4 years and 10 months: between prison and house arrest she served about a year, for the rest of the sentence she was entrusted to social services, where she will do volunteer work for a local association.

The judges of the Court of Appeal had sent the documents back to the Constitutional Court to evaluate the defense's request to grant mitigating circumstances for having acted for reasons of particular moral and social value. Constitutional Court which, then, recognized that the mitigating circumstances prevailed over the aggravating circumstance of the relationship of kinship, the mitigating circumstances of provocation and to protect the child.

"With a fair final decision - comments the defender Lorenzo Repetti - an end is put to an ugly family story that has caused pain and suffering to Tina and, certainly, also to her son Andrea. They have been long years of violence, in fact, not only for Barbieri".

On July 11, 2021, in the house of Borghetto Borbera, after sedating her husband, the woman tightened his neck with shoelaces. She was then the one who alerted the Carabinieri and waited for them.

In the last three months, the escalation of violence had become unbearable, a situation known to Borghetto: at the beginning of January 2022, the lawyers - at the time Lorenzo Repetti was supported by Silvia Nativi - had received a collection of signatures spontaneously started by fellow villagers to make them feel their closeness also to their son Andrea, not spared by his father's violence.
