Medically assisted suicide, first case in Tuscany after the approval in February of the regional law on times and methods , drafted starting from the 'Liberi subito' bill proposed by the Coscioni association, then challenged by the Government .

The association reports the news: «On May 17, in the province of Siena - he explains -, Daniele Pieroni, a writer, was able to choose with clarity and serenity to end his life thanks to the ruling 242/19 of the Consulta and the Tuscan law . The man, 64 years old, had been suffering from Parkinson's disease since 2008 and, due to severe dysphagia, was forced to live with the Peg in use for 21 hours a day ».

"This is the first case of assisted voluntary death in the Region since the law came into force, confirming its full applicability by virtue of constitutional judgment, despite the challenge by the Government," explains the association.

When the government announced in May that it would appeal to the Constitutional Court regarding the law, the president of the Tuscan Regional Council Antonio Mazzeo himself explained that the law would remain in force until the Constitutional Court issued a ruling.

Pieroni in August 2023, through a friend, it is further explained in a note, «had contacted the Bianco number of the Luca Coscioni association to receive information on how to access assisted voluntary death. During the day, Marco Cappato had provided him with all the necessary information including information on advance treatment directives, on the deep palliative sedation path and on the detachment of ongoing treatments . Daniele chose the path provided for by the Cappato ruling and sent the formal request to the ASL Toscana Sud Est on August 31. After receiving, last April 22, the positive outcome of the checks required by the Constitutional Court ruling known as 'Cappato-Dj Fabo', Daniele, less than a month later, confirmed his desire to proceed at home. Everything took place in full compliance with the procedure provided for by Tuscan law and the conditions established by the Consulta. The lethal drug was prepared at his home, which Daniele self-administered ».

Present, "on a voluntary basis, were two female doctors and a medical examiner from the ASL, who acted with great humanity and professionalism, as confirmed by those who were present. Next to Daniele were Felicetta Maltese, coordinator of the Tuscan cell of the Luca Coscioni association, his trustee Leonardo Pinzi, his caregivers and family members. At 4:47 pm Daniele activated the double infusion pump device and at 4:50 pm he stopped breathing, peacefully".

«It is the demonstration of how vain the attempt to declare it unconstitutional is, of how the Region has temporarily filled a void , which we do not have the presumption of filling forever: it is appropriate that a national law can give rise to an adaptation in terms of law of what the Constitutional Court has affirmed in terms of principles», stated the president of the Tuscany Region Eugenio Giani .
