Accused of sexual assault against a minor, he is acquitted because the fact does not exist.
The sentence in Sassari, in recent days in court, of the panel presided over by Monia Adami, with Valentina Nuvoli and Paolo Bulla on her sides, for events dating back to 2021. When, according to the accusations, a young man from the hinterland, 18 years old at the time, allegedly held a 16-year-old girl inside the passenger compartment of his car, forcing her to undergo sexual acts, consisting mostly of kisses.
The girl had gone by car of her own volition after the two had exchanged kisses in the bathroom of a club. Then she would have written a message to her friends with the phrase "He's going to rape me", alarming everyone also because, when she reached them, she was crying. In a hearing it was also mentioned that she feared her father's reaction to the news of what had happened.
And it was in fact the parents who filed the complaint, which, although not formalized, since it is a crime that can be prosecuted ex officio, went ahead. Despite the fact that on one occasion the prosecutor had asked for the case to be archived, but had encountered opposition from the investigating judge, and on the other occasion he had reclassified the charge as attempted sexual assault, while instead, during the preliminary hearing, the judge had invited the accusation to be reformulated as sexual assault.
Thus the boy was sent for trial and the conclusion cited at the end of the discussion was reached in which the public prosecutor Angelo Beccu had requested the acquittal and the defense, represented by the lawyers Pietro Diaz and Carlotta Pilo, had joined the request considering their client completely innocent.
