Graziano Mesina refuses treatment and any diagnostic test, therefore "it is not possible to arrive at a certain diagnosis of his health conditions" .

The Surveillance Court of Milan wrote this in a provision with which it decided that the ex Supramonte bandit, imprisoned in the Opera prison, cannot be granted the deferment of the sentence with detention under house arrest .

And it is precisely the former Scarlet Pimpernel's opposition to treatment and diagnosis that does not allow the deferment of the sentence, reads the provision.

Mesina, 80, detained in Milanese prison since last June , takes an "oppositional attitude" to the treatments and attempts by the medical staff , to whom he offers no collaboration, to arrive at a certain diagnosis.

His conditions, as far as it is possible to ascertain, are evaluated as «apparently fair» . Basically, since it is not possible to deepen the diagnostic framework in the face of the prisoner's refusal, the deferment of the sentence cannot be granted , the judges write in an open official proceeding and without a defense instance.

A principle, the one expressed by the magistrates, similar and in line with that which in recent days has led the Milanese Surveillance to reject the request for deferment of the sentence with home detention advanced by the anarchist Alfredo Cospito .

Mesina, a former exponent of Sardinian banditry, who escaped several times (the last one in 2020) and with the end of his sentence expected in December 2045, according to the records, decided to "self-resign" from treatment at the beginning of last December . For him, among other things, in recent days the Surveillance Court of Sassari (previously he was detained in Sardinia) rejected the request for home detention for health reasons advanced by his defense, according to which the former fugitive is ill due to advancing age and too sedentary life.
