The Lazio TAR rejected the appeal presented by Codacons , defining "legitimate" the Ordinance with which the Ministry of Health , acknowledging the text of the amendment to the Law Decree on the so-called "end of the state of the emergency", ordered the obligation for students to wear the FFP2 mask in school environments and, therefore, also in the high school and eighth grade exams .
At the basis of the judges' decision, the finding that the Law Decree 52/2021 for the obligation in question provides for the use of masks " until the end of the school year 2021/2022".
And, the judges underline, given that "before the carrying out and conclusion of the aforementioned exams it certainly cannot be decreed for the end of the relative school year for students", the masks must be kept , even if in a few days they will no longer be mandatory in the places indoors.
For the high school diploma, the first test will take place on Wednesday 22 June ; while for the eighth grade exam the date is set by the individual institutes, but the tests must in any case be completed by 30 June ".
"For the purposes of eliminating the aforementioned measure in advance of the final deadline legally imposed by the state, thus allowing students to take exams without the obligation to use masks - continues the TAR - a specific decree-law would be necessary , pending the inadequacy of a ministerial public health order to dispose in a different sense to the provisions of a specific provision of legislative rank, in the absence of a provision that expressly allows it ".
REACTIONS - The sentence immediately triggered reactions. For Codacons this is a "very serious and wrong" decision.
"If someone like my son has the maturity - says the leader of the League Matteo Salvini - know that we are battling with Minister Speranza to remove the mask: we attended the concerts of Vasco Rossi and the
victory of the AC Milan championship with thousands of people gathered without masks and then pupils and teachers are forced to stay six hours straight in class with their noses and mouths blocked. There is someone in the government who is a little confused. But we go straight to this issue ".
