For over twenty years she was a cashier in a supermarket inside a shopping centre in Modena, until 2024, when she was fired for a colander and a saucepan, worth 30.52 euros .
And now the Modena court has ruled in favor of the employee and in favor of the company , also sentencing the former to pay 1,500 euros in legal costs, after the employee herself challenged the decision before the labor court.
The Corriere di Bologna newspaper reported the news. The company argued that the reason for the dismissal was that the woman had knowingly and maliciously brought a colander and a wok with her, in order to prevent the barcode from being read by the checkout's optical scanner .
A circumstance that, according to the Modena judge, is confirmed by the video surveillance footage inside the supermarket. At the end of the transaction, according to the court, the receipt was sealed and the security guard intervened and noted the failure to register the two items. For the court, it is the established behavior, not the value of the goods, that leads to the interruption of the trust relationship and thus legitimizes the dismissal .
The ruling states: "The video clearly shows that this was not a case of momentary inattention, as the worker clearly moved the two products from the conveyor belt and brought them, without reason, close to her body, lifting them above the checkout counter ."
