Cagliari, no to expansion works in the Solinas villa

The request of the former president of the Region, Christian Solinas, to renovate and expand the villa in via dei Tritoni, in Cagliari, purchased a few years ago and currently partly subjected to precautionary seizure as part of an investigation by the Prosecutor's Office, was rejected by the Municipality for alleged corruption. The municipal offices denied the request to start the works, motivating the measure with the presence of constraints linked to the Molentargius park and the risk that the noise from the construction site disturbs the protected fauna of the nearby pond. The former governor, through lawyers Salvatore Casula and Silvio Pinna, presented an appeal to the President of the Republic in recent days, contesting the legitimacy of the municipal provision and requesting its annulment.
The negative opinion
The negative opinion arrived in February, after the "asynchronous" services conference (each interested body expressed its opinion separately) activated by the Municipality. The former president intends to renovate the now old building he purchased, modifying the interiors and slightly expanding the volume by a few dozen cubic metres. The house - as communicated in the services conference by the park authority - is located outside the perimeter of the Molentargius oasis, but for the strategic and territorial planning service and for the soil and environmental hygiene service of the Municipality, the area would be almost entirely subject to constraints. And to confirm this, the private construction technicians would cite not so much the regional landscape plan (PPR), but rather the provisions of the old territorial landscape plan of Molentargius.
Acoustic problems
The border of the restricted area, among other things, would pass right next to Solinas' property: his new house would fall within the protected area (with all the relevant prohibitions), the neighboring property, however, is outside the protected area (as also ascertained by an investigation by the Prosecutor's Office into the neighboring building which was closed because everything was found to be in order). In denying the green light for the works, the Municipality highlighted that an increase in volume is not permitted in the restricted area and that there would be acoustic risks for the fauna of the pond.
The extraordinary appeal
In recent days, before the expiry of the 120 days provided for by the law, the former governor with his lawyers presented an extraordinary appeal to the Head of State, considering the municipal provision illegitimate and requesting its annulment, given that other interventions. Now within 60 days the Municipality will have to decide whether to request the transposition of the proceedings: in that case the dispute would be transferred to the Sardinia Regional Administrative Court. Otherwise, the President of the Republic will ask the Council of State for an opinion and, once the investigation is completed, he will pronounce his own decree. In short: the battle has begun.
